Today, the Arkansas Bar Association (ABA) revealed that the Bar Exam tests from the Little Rock area are missing following Wednesday’s exam. The Bar Association will require exiting law students to retake the MBE portion of the exam which has been rescheduled for August 7th.
The completed exam papers were lost while being packaged for shipment to the National Conference of Bar Examiners who grades the final test.
“The box was sitting next to a number of practice booklets when I walked out of the room,” the bar association’s exam coordinator Julia Shumway tells us. “We are required to destroy the practice booklets each session following the exam. I came back and the practice booklets were still there and the real exams were gone.”
The Multistate Bar Examination (MBE) is administered in every state except Louisiana and Washington. The MBE is a six-hour, two-hundred question multiple choice examination completed on the second day of examination. The MBE accounts for 50% of the total bar exam score.
MBE rules stipulate that all retest must be taken using completely new exams. The ABA is encouraging all test takers to repeat as many study methods as possible. In a statement following the announcement the ABA says that “while the loss is unfortunate, we believe many future lawyers will ultimately be excited to show off their legal skills again.”

I just sat for the Utah Bar the past two days. A few terms come to mind that I’m sure the Arkansas Bar Examiners are familiar with. At least I hope they are, seeing as how we were expected to know them inside and out. Res ipsa loquitor. Negligent infliction of emotional distress. Vicarious liability (NCBE).
The NCBE understandably has strict rules in how its exam is administered. But, this is in a word, unacceptable. I am sure the Arkansas Bar Examiners are going to make August 7th as pleasant as possible for those retaking the MBE. While, we are excited about practicing law, we are not excited about having to experience undue stress as a result of less than “minimal competence” on the part of those who stand as gatekeepers to our profession.
To those who must retake the MBE: take this opportunity to do some extra studying. Yesterday was an opportunity to see what you were still struggling with. Go and make those weak points strong for next Wednesday. You all had an extra practice exam. Take advantage of it.
Mistakes happen. Arkansas Bar Examiners—take responsibility and make restitution as far as you are able. Arkansas Bar Examinees—seize the opportunity and demonstrate that we are truly part of an honorable profession.

Who is going to reimburse all the people who travel and stat in hotels or drive long distances? Who is the idiot who thinks they will be excited to show their skills again? He should be required to retake the six hour test to keep his license!

I took the exam too. When I read this I thought it was real (Im gullible) and was tripping for a minute. I was glad to find out it was not real, BUT, I could totally see them making you take it over due to their own negligence. Nice laugh though….
